Welcome to Pay-Tek.co, a Canadian-based payment processing service. By accessing or using our website (Pay-Tek.co), services, or platform, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use our services.

Definitions

  • “Pay-Tek.co”, “we”, “us”, or “our” refers to Pay-Tek.co, a Canadian company providing payment processing solutions.
  • “User”, “you”, or “your” refers to any individual or entity using our services, including merchants and customers.
  • “Services” include payment processing, merchant dashboards, weekly payouts (credit card, Interac, crypto), and related features.

Eligibility
To use our Services, you must:

  • Be a registered business or individual operating in Canada, at least 19 years old, and authorized to conduct business in your industry.
  • Provide accurate information during onboarding, including business details.
  • Not use our Services for illegal activities, including but not limited to money laundering, fraud, or prohibited transactions under Canadian law.

Services Provided
Pay-Tek.co offers:

  • Payment processing set up within as little as 3 hours.
  • Low-fee processing for credit cards, Interac (EMT), cryptocurrency, and in-person QR code payments.
  • Transaction security for discreet operations.
  • Real-time merchant dashboard for tracking transactions, revenue, payouts, and custom invoices.
  • Weekly payouts with custom splits (ATM card, EMT, crypto, etc.).
  • 24/7 Canadian-based support and mobile checkout with 2-second payment updates.
    We reserve the right to modify or discontinue Services with notice, subject to applicable law.

User Responsibilities
You agree to:

  • Provide accurate, complete information during account setup and maintain its accuracy.
  • Comply with all applicable Canadian laws, including anti-money laundering (AML) and consumer protection regulations.
  • Protect your account credentials and notify us immediately of unauthorized access.
  • Accept responsibility for any chargebacks, disputes, or compliance reviews resulting from your transactions.
  • Use our Services only for lawful business activities.

Fees and Payments

  • Processing fees are outlined in your merchant agreement and vary by transaction type (credit card, Interac, crypto).
  • Weekly payouts are subject to a minimum balance and may incur additional fees for custom splits.
  • You are responsible for any taxes, duties, or charges arising from transactions.
  • Pay-Tek.co may withhold or reverse payouts for suspected fraud, chargebacks, or compliance issues, with notice provided.

Transaction Discretion

  • Our transaction security is designed to protect the privacy of your business and customers within legal limits.
  • You warrant that transaction security will not be used to conceal illegal activities or evade regulatory oversight.
  • Pay-Tek.co is not liable for any misuse of security features resulting in legal consequences.

Account Suspension and Termination
We may suspend or terminate your account if:

  • You violate these Terms or applicable laws.
  • Your account is linked to fraudulent activity, excessive chargebacks, or non-compliance with AML regulations.
  • You fail to pay fees owed or resolve disputes promptly.
    Upon termination, you must cease using our Services, and any pending payouts may be held to cover transaction disputes.

Intellectual Property
All content, software, and designs on Pay-Tek.co.net, including the merchant dashboard, are owned by Pay-Tek.co or licensed to us. You may not copy, modify, or distribute them without written consent.

  1. Limitation of Liability
  • Pay-Tek.co provides Services “as is” and is not liable for losses due to transaction failures, chargebacks, or third-party actions (e.g., bank freezes).
  • Our liability is limited to the fees paid to us in the prior 12 months. We are not responsible for indirect, incidental, or consequential damages.
  • You indemnify Pay-Tek.co against claims arising from your misuse of Services or violation of these Terms.

Privacy and Data Security

  • We collect and process personal/business data per our Privacy Policy (available at Pay-Tek.co./privacy-policy).
  • You consent to our use of data for payment processing, fraud prevention, and compliance checks.
  • Pay-Tek.co uses industry-standard encryption but is not liable for breaches caused by your negligence or third-party actions.

Dispute Resolution

  • Disputes will be resolved through good-faith negotiation. If unresolved, they are subject to binding arbitration in Vancouver, BC, under Canadian law.
  • You waive any right to class action lawsuits.

Modifications to Terms
We may update these Terms at any time, with changes effective upon posting to Pay-Tek.co.net. Continued use constitutes acceptance.
